Implications of the European AI Act on Meta’s Llama 3.1 models

Introduction

The European AI Act, presents a significant regulatory challenge for Meta’s implementation of its Llama 3.1 AI models. The Act, designed to safeguard EU consumers and citizens, categorizes high-impact AI models as “systemic risks” based on their computational power, which could potentially obstruct the deployment of advanced AI technologies within the EU.

Regulatory framework of the AI Act

Article 51: Classification of General-Purpose AI Models as General-Purpose AI Models with Systemic Risk

  1. A general-purpose AI model shall be classified as a general-purpose AI model with systemic risk if it meets any of the following conditions:
    (a) it has high impact capabilities evaluated on the basis of appropriate technical tools and methodologies, including indicators and benchmarks;
    (b) based on a decision of the Commission, ex officio or following a qualified alert from the scientific panel, it has capabilities or an impact equivalent to those set out in point (a) having regard to the criteria set out in Annex XIII.
  2. A general-purpose AI model shall be presumed to have high impact capabilities pursuant to paragraph 1, point (a), when the cumulative amount of computation used for its training measured in floating point operations is greater than 10(^25).
  3. The Commission shall adopt delegated acts in accordance with Article 97 to amend the thresholds listed in paragraphs 1 and 2 of this Article, as well as to supplement benchmarks and indicators in light of evolving technological developments, such as algorithmic improvements or increased hardware efficiency, when necessary, for these thresholds to reflect the state of the art.

The AI Act aims to regulate AI systems to ensure they are safe and trustworthy. Under Article 51 of the Act, a general-purpose AI model is deemed to have systemic risk if it possesses high-impact capabilities. This classification is determined through specific technical metrics, benchmarks, and evaluations, which include the cumulative computational power used during training.

According to Article 51, paragraph 2, an AI model is presumed to have high-impact capabilities if it utilizes more than 1025 floating point operations (FLOPs) in its training process. The Act empowers the Commission to adjust these thresholds and benchmarks in response to technological advancements, ensuring that the regulations remain current.

Technical specifications of Llama 3.1

Meta’s technical documentation for the Llama 3 family, including the 3.1 models, highlights their substantial computational scale:

  • The flagship model of Llama 3.1 was pre-trained using 3.8×1025 FLOPs.
  • This is nearly 50 times the computational power used for the largest version of Llama 2.
  • The model features 405 billion trainable parameters and was trained on 15.6 trillion text tokens.

These specifications significantly exceed the AI Act’s threshold for systemic risk classification. As such, under the current regulatory framework, Llama 3.1 models could be restricted from deployment within the EU.

We train a model at far larger scale than previous Llama models: our flagship language model was pre-trained using 3.8 × 1025 FLOPs, almost 50× more than the largest version of Llama 2. Specifically, we pre-trained a flagship model with 405B trainable parameters on 15.6T text tokens.
